Disclaimer and Limitation of Liability

OpenSailingRC is an open-source project. We freely share our know-how, schematics, source code, firmware, and solutions in a collaborative and community-oriented spirit. All of this content is provided for purely informational and educational purposes.


Supply "as is"

The information, plans, electronic schematics, source code, firmware, protocols, and documentation are provided "as is," without warranty of any kind, express or implied. This includes, but is not limited to, any warranty of quality, reliability, availability, performance, fitness for a particular purpose, or absence of error or defect.


Responsibility for implementation and use

The design, construction, assembly, programming, deployment and use of buoys and ground stations are the sole and exclusive responsibility of the persons who manufacture, implement or use them.

OpenSailingRC, its authors and contributors provide no guaranteed support and cannot be held responsible for the proper functioning, performance, results obtained, or consequences of any achievement or use, including in the event of malfunction, failure, unexpected behavior or loss of control of the hardware.


No liability for damages

To the extent permitted by applicable law, OpenSailingRC, its authors, and contributors disclaim all liability for any damages, direct or indirect, of any kind whatsoever, that may result from the use of, or inability to use, the shared solutions. This includes, but is not limited to:

  • material damage (buoys, boats, electronic equipment, batteries, etc.);

  • bodily injury or accidents;

  • financial losses, operating losses or data losses;

  • damage caused to third parties or their property;

  • environmental damage.


Safety, marine environment and regulations

Buoys are autonomous devices designed to be deployed on the water. Their use involves inherent risks: navigation, collision, drift, loss of equipment, changing weather conditions, among others.

It is the responsibility of each user to ensure that its creation and use comply with applicable local and national regulations, particularly regarding:

  • radio frequencies and transmission power (e.g. 433 MHz or 868 MHz bands), including obtaining any required authorizations;

  • navigation, buoyage and maritime safety;

  • protection of the environment and species;

  • Electrical safety and battery transport.

Obtaining all necessary permissions and complying with these regulations are the sole responsibility of the user.


Community contributions

The project may incorporate contributions from third parties. OpenSailingRC does not guarantee or validate the accuracy, security, quality, or legality of these external contributions, which remain the responsibility of their respective authors.


Change to this warning

This warning may be modified, supplemented, or updated at any time without prior notice. It is the user's responsibility to regularly consult the current version.


Acceptance

By creating, assembling or using a buoy or station based on OpenSailingRC solutions, you acknowledge that you have read, understood and accepted all of the limitations of liability set out above.
